KUCHING: An employed man who hit his mother using a piece of wood taken from a fence was sentenced to four years’ imprisonment and two strokes of whipping by the Sessions Court here today.
Judge Shafiza Datuk Abdul Razak Tready meted out the sentence to 32-year-old Mohammad Sayhdan Husain after he pleaded guilty to a charge under Section 324 of the Penal Code, read together with Section 326A of the same Code.
Section 324 of the Penal Code provides for imprisonment of up to 10 years, or a fine, or whipping, or any two of these punishments.
The court heard that Mohammad Sayhdan committed the offence at about 7am on Oct 5 at a house near Kampung Pulo Hilir, where he hit his 60-year-old mother with the wooden object.
The incident occurred after his mother reprimanded him for making noise and rambling incoherently after leaving his bedroom.
He became angry, triggering a heated argument between them, before taking a piece of wood from the fence and striking his mother.
His mother sustained an injury to her left palm as she attempted to shield herself from further blows.
She subsequently lodged a police report, leading to Mohammad Sayhdan’s arrest the following day, Oct 6.
Investigations revealed that the accused lived with his mother and had intentionally struck her with the wooden object.
In a separate case at the Magistrates’ Court, Mohammad Sayhdan was sentenced to eight months’ imprisonment for consuming amphetamine and methamphetamine.
Magistrate Leona Dominic Mojiliu imposed the sentence after he pleaded guilty to a charge under Section 15(1)(a) of the Dangerous Drugs Act 1952, punishable under Section 15(1) of the same Act.
Both sentences from Sessions Court and Magistrates’ Court are to run from the date of conviction (Oct 9).
The court also ordered him to undergo police supervision for three years after completing his prison sentence.
The court heard that he tested positive for both drugs at the Kuching District Police Narcotics Crime Investigation Department office at 11.45am on April 15.
Police had taken him for a urine test, with the initial screening returning positive results for amphetamine and methamphetamine.
His urine sample was subsequently sent to the Pathology Department of Sarawak General Hospital for analysis, which confirmed the presence of both drugs.
Amphetamine and methamphetamine are listed under the First Schedule of the Dangerous Drugs Act 1952.
Deputy public prosecutors Chuah Kai Sheng and Ahmad Fauzulutfi Suriani appeared for the prosecution in the respective cases, while Mohammad Sayhdan was unrepresented in both proceedings.
